Terms of Service

Disclaimer:

Unixdemon takes no responsibility for any damages or losses Customer's business may suffer due to use of Unixdemon products and services. Unixdemon takes no responsibility for the data and or files contained in Customer's directories. Customer agrees to assume full responsibility for data/files contained in Customer's home directory and all of its subdirectories.

Unixdemon reserves the right to change and or modify its policies at any given time without any prior notice. If Customer violate any terms and conditions, Unixdemon has the right to deactivate any account on Unixdemon machines.

Payments:

Unixdemon will not activate any account ordered by Customer until Customer has paid the first term's fee for that account. Only at the discretion of a Unixdemon administrator can Customer have Customer's account activated before payment. All first payments must be paid in full, without exception.

If your invoices becomes public for any reason, Customer is obligated to notify Unixdemon. All Unixdemon invoices are payable upon receipt, and are due one week prior to the commencement of the next billing period. Cancellation of Customer's account should be given no less than one week prior to the next billing period. Failure to make timely payments may result in temporary account deactivation.

If Customer billing status is delinquent for more than a two week period, Customer's account will be deleted along with all data in the Customer's directories. In this case, Customer may be allowed to retreive any and all data in Customer's directories, but this will be at Unixdemon discretion. Customers who wish to reactivate a delinquent account will be charged with a reactivation fee and the normal price for the next billing period.

System Uptime:

Unixdemon will make access available to you on a best-effort basis. Although our current uptime is beyond average, outages can occur. Unixdemon cannot and will not make a guarantee of any services provided to our customers. If in the event of an outage lasting more than 36 hours, at the request of Customer, we will prorate the applicable portion of your account's term.

Abuse:

Unixdemon reserves the right to decide what constitutes abuse of any of Unixdemon machines, personnel, or customers.
Unixdemon reserves the right to refuse service to anyone.

Server abuse includes, but is not limited to the following:

a) Hacking or cracking any Unixdemon machines
b) Storage of warez, illegal mp3 music files, pornography, exploits, or any illegal copyrighted content for any purpose
c) Sending unisolated messages to others, known as spam, for Customer's website, email, dns, or for Unixdemon
d) Scanning or flooding directed at or from Unixdemon machines

Account Sharing:

Account is to be used by Client only. Client is defined as the person listed on the Unixdemon service order. Client is responsible for activity in Client account. Client may not resell, trade, or give away access to account, without expressed permission from Unixdemon. This includes sharing of accounts or processes, such as bouncer programs.

Violation of these afore-mentioned constitutes breach of contract and will result in immediate account suspension and/or termination, without refund. All files, e-mail, domains, or other account items will become property of Unixdemon.

Early Account Terminations or Suspensions:

Unixdemon reserves the right to suspend any account, for any reason, at any time. Best effort to contact Customer will be made by Unixdemon before account suspension. Removal of an account may occur 2 days after a suspension. Unixdemon disclaims any responsibility and warranty for any data contained in Customer's account during the removal of that account.

Violations of these policies will represent a breach of your contract with Unixdemon, resulting in suspension and/or removal of your account from our systems without warning. Anyone who breaches this contract between Customer and Unixdemon is not subject to a refund, unless specified otherwise by an administrator.

Username and Domain Changes:

In order to change your account username, we are required to delete your account and recreate it all over again like you were just signing up. Due to the effort and time needed to do so, a $5 charge may be added to your next invoice. Unixdemon assistance in domain name assignment changes are complimentary.

General Account Usage Of Service By Client:

Client may not:
- run greater than allotted processes.
- have more than 3 (three) IRC connections per process.
- bind to IP addresses/hostnames that are not public, without expressed permission.
- invoke crontab less than every 10 minutes.
- promote, entice, or participate in -- or attempt to participate in -- denial of service attacks; if Client is found to be receiving denial of service attacks frequently, account may be suspended or terminated, without refund, by Unixdemon.
- run webcams, shoutcast servers, any type of game server, or any other process that utilizes an unreasonable amount of bandwidth or system resources, without expressed permission.
Violation of the afore-mentioned constitutes breach of contract and will result in immediate account suspension and/or termination, without refund. All files, e-mail, domains, or other account items will become property of Unixdemon.

Web Hosting Policies:

Websites being hosted by Unixdemon are to be used by the owner of the account and not resold, unless agreed to by Unixdemon. Customer is not permitted to resell space or give away website hosting services to another party, unless permission from Unixdemon is granted in writing. Web hosting services are defined as allowing a separate third party to host content on the owner's web site. Ad banners, classified ads, and personal ads are excluded from this restriction.

Shell Account Policies:

Customer agrees to only use allocated disk space for the software and data being used on Customer's account. Customer agrees that the processes being run on the shell will not connect more than once per process to any IRC Network, with the exception of bouncing software. Customer agrees that software used by Customer is the legal property of the Customer, and that this software will not intentionally cause or be used to cause harm to Unixdemon, its customers, or the Internet community at large. Server abuse will lead to suspension and/or removal of Customer's account, potential legal prosecution, with no refund owed to Customer.

Customer agrees that processes being run from Customer's account are not to be used to redistribute files of legal or illegal nature. Customer agrees that any amount of bandwidth over 100 megabytes/month and any number of concurrent background processes greater than 5/month from Customer's account is excessive and is grounds for account suspension or removal. Customer also agrees that Customer initiated floods, hacking attempts, or any malicious action intended to cause harm to another, for any reason, is grounds for immediate account suspension/removal and prosecution.

IRCD Account Policies:

Customer agrees to only use allocated disk space for the software and data being used on Customer's account. Customer agrees that any IRCD found to be storing DDOS/packet bots on them will result in account termination without refund. Customer agrees that Customer is responsible for maintaining his/her network. Information will be turned into the FBI or your local authority. Any material not mentioned above is left entirely to the discretion of the Unixdemon administration. Server abuse will lead to suspension and/or removal of Customer's account, potential legal prosecution, with no refund owed to Customer. Customer agrees that software used by Customer is the legal property of the Customer, and that this software will not intentionally cause or be used to cause harm to Unixdemon, its customers, or the Internet community at large.

Customer agrees that processes being run from Customer's account are not to be used to redistribute files of legal or illegal nature. Customer also agrees that Customer initiated floods, hacking attempts, or any malicious action intended to cause harm to another, for any reason, is grounds for immediate account suspension/removal and prosecution.

Terms and Condition Updates:

Unixdemon reserves the right to change any policies, prices, or configuration of any and all accounts when deemed appropriate and necessary.
